Folsom Labs, Inc., a Delaware Corporation (“Folsom Labs”“we”“our”, or “us”) is committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, store, process, transfer and use data that identifies you or makes you identifiable, as a natural person (hereinafter “personal information”).

This Privacy Policy applies to our websites, including www.helioscope.com, and any other website that links to this Policy (our “Sites”), to our products and services (collectively, our “Service”). By accessing or using our Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service.

WHO IS THE CONTROLLER OF YOUR PERSONAL INFORMATION?

Folsom Labs is the controller of your personal information. We are responsible for, and control, the processing of your information.

Wherever our customers use our Service to process content relating to third parties (containing personal information relation to these third parties), we have contractually committed ourselves to only process such information on behalf and under the instruction of the respective customer, who is the data controller. This Privacy Policy does not apply to such processing and we recommend you to read the Privacy Policy of the respective customer, if their processing concerns your personal information.

WHAT INFORMATION DO WE COLLECT?

In the context of rendering our Services, we may collect information about you. This information regularly includes the following:

  • If you sign up for a free trial and create an account or request our products or services on behalf of your company or if you make a purchase: Name, company name, email address, phone number, IP address and browser metadata, billing address, and credit card information. In addition, we collect your input data on the solar projects you are working on, which include the locations of projects, names of customers, engineering details (such as component used in the array, system size and energy yield calculations) and the costs and revenues generated by the solar plant.
  • If you contact us (via our Sites or via phone, email or letter), e.g. for an information request support request or any other inquiry: email address, information on our communication with you and any additional information you provide us with.
  • If you sign up for our newsletter: Name, email address, information on whether you are already a customer, marketing campaign information such as your reaction to our marketing, whether you open our marketing emails or click the links contained in these emails.
  • If you merely visit our Sites: IP address, information on what pages you visit, browser data, browser type, device type, device ID, Uniform Resource Locators (URL), date/time stamp, language preferences, and other actions you take on the Sites.

HOW DO WE COLLECT YOUR INFORMATION?

This personal infrmation is collected in many ways and may include:

  • personal information you provide to us directly: Most of the personal information we receive comes to us voluntarily from our users in the course of using our Services, such as when visiting our Sites, communicating with us or in the process of requesting and using our Service.You are free to choose which information you want to provide to us or whether you want to provide us with information at all. However, some information, such as your name, email address, payment information and information on your requested Services may be necessary for the performance of our contractual obligations.   • We use your information in order to perform our contractual services or in preparation for a contract with you. If you order Services from Folsom Labs or if you contact us to request our Services, we use your information to provide to you the features and functionality of the Services. Information we use includes: information we need to contact you or otherwise communicate with you; information to manage your account; information to enable the usage of Services; information necessary for customer support; information for invoicing and payment follow up.
  • We use your information if justified by our legitimate interests. The usage of your information may also be necessary for our own business interests. For example, we may use some of your information to evaluate and review our business performance, create financial statements; improve our Services or to identify potential cyber security threats. Any such service providers and advisors will be given limited access to personal information as it reasonably necessary for delivering its service and will, by appropriate data processing agreements, be bound to only process personal information on Folsom Labs’ behalf and under its instructions;

As we are located in the USA, any information you provide, will be processed and stored in the USA. In general, customer data will be retained for five years after the account creator and all users become inactive, or can be deleted immediately upon request.

CHILDREN’S PRIVACY

Folsom Labs does not knowingly collect or solicit any information from anyone under the age of 13 on this Service. In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from a child under 13, please contact us using the contact details listed at the end of this Privacy Policy.

From children under the age of 16 residing in the EU, we will not process any personal information on the ground of a consent.
